1    INTRODUCTION


Predictive Science, Inc. (“Predictive Science”, “our”, “us” or “we”) is proud of our privacy practices and want you to know how we protect your information submitted or collected through your use of the Predictive Science Platform, including any content, functionality and services offered on or through PredictiveScience.com (“Site”). We provide this Privacy Policy to inform you of our policies and procedures regarding the collection, use, and disclosure of personal information we receive from you with respect to your use of the Predictive Science Platform.

This Privacy Policy applies to information we collect on this Site and with respect to the Predictive Science Platform, including through email, mobile messaging, and other communications between you and the Predictive Science Platform. It does not apply to information collected by us offline or through any other means, including on any other website operated by us or any third party (including any affiliates and subsidiaries) and does not apply to any third party (including any affiliates and subsidiaries), including through any application or content that may link to or be accessible from or on the Predictive Science Platform.

Please read this policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, your choice is not to use the Predictive Science Platform. By accessing or using the Predictive Science Platform, you agree to this Privacy Policy. This Privacy Policy may change from time to time. Your continued use of the Predictive Science Platform after we make changes to the Privacy Policy is deemed to be acceptance of those changes, so please check the Privacy Policy periodically for updates.

Unless otherwise defined in this Privacy Policy, terms used in this Privacy Policy have the same meanings as in our Terms of Service.

1.1           Changes to Our Privacy Policy

It is our policy to post any changes we make to our Privacy Policy on this page. If we make material changes to how we treat our users’ personal information, we will notify you by email to the primary email address specified in your account or through a notice on the Site home page. The date the Privacy Policy was last revised is identified at the top of the page. You are responsible for ensuring we have an up-to-date active and deliverable email address for you, and for periodically visiting our Site and this Privacy Policy to check for any changes.

1.2          Eligibility

The Predictive Science Platform is not intended for persons under 15 years of age. By using the Predictive Science Platform, you represent and warrant you are at least 18 years of age, or, if you are under 18 years of age (but 15 years of age or older), then you affirm the you possess the legal consent of your parent or guardian to access and use the Predictive Science Platform. Predictive Science may, in its sole discretion, modify all or any portion of the Predictive Science Platform for those persons under 18 years of age or for any other Users.

No one under age 13 may provide any information on the Predictive Science Platform. We do not knowingly collect personal information from children under 13. If you are under 13, do not use or provide any information on the Predictive Science Platform or on or through any of its features. A parent or guardian becomes aware that his or her child has provided us with Personal Information without their consent, he or she should contact our support team immediately. If we learn we have collected or received personal information from a child under 13 without verification of parental consent, we will use commercially reasonable efforts to delete that information. If you believe we might have any information from or about a child under 13, please contact us at legal@predictivesciences.com.

1.3          Operated from the United States

The Predictive Science Platform is controlled and operated from the United States. Predictive Science makes no representations that the Predictive Science Platform is appropriate or available for use in other locations. Those who access or use the Predictive Science Platform from other locations do so at their own choice and are entirely responsible for compliance with all applicable foreign, United States, state, and local laws and regulations, including, but not limited to, export and import regulations, including the Export Administration Regulations maintained by the United States Department of Commerce and the sanctions programs maintained by the Department of the Treasury Office of Foreign Assets Control. You must not directly or indirectly sell, export, re-export, transfer, divert, or otherwise dispose of any software or service to any end user without obtaining any and all required authorizations from the appropriate government authorities. You also warrant that you are not prohibited from receiving U.S. origin products, including services or software. You may not use or access the Predictive Science Platform if you are: (a) a resident of a geographic area embargoed by the United States; (b) subject to United States economic sanctions that prohibit your use or access to the Site; or (c) a foreign person or entity blocked or denied by the United States government. Unless otherwise explicitly stated, all materials found on the Predictive Science Platform are solely directed to individuals, companies, or other entities located in the United States.

1.4          Links to Other Sites

The Predictive Science Platform contains links to other websites. If you choose to click on a link to another website, you will be directed to that other website. The fact that we link to a website is not an endorsement, authorization or representation of our affiliation with any third party, nor is it an endorsement of a third party’s or another website’s privacy or information security policies or practices. We do not exercise control over third party websites. These other websites may place their own cookies or other files on your computer, collect data, or solicit personal information from you. Other websites follow different rules regarding the use or disclosure of the personal information you submit to them. We encourage you to read the privacy policies or statements of the other websites you visit.

2    INFORMATION WE COLLECTED ABOUT YOU AND HOW WE COLLECT IT


Our primary goals in collecting information are to provide and improve the Predictive Science Platform, services, features and content and to enable users to enjoy and easily navigate the Predictive Science Platform.

2.1          Personally Identifiable Information

In the course of using the Predictive Science Platform (whether as a Client or Provider or User in some other capacity), we may ask you to provide us with, or grant us access to, or permission to obtain, certain personally identifiable information that can be used to contact or identify you; personally identifiable information may include, but is not limited to, your name, company name, email address, postal address, and phone number (“Personal Information”).

If you use the Predictive Science Platform to make or receive payments, we will also collect certain Personal Information such as credit card information, bank account numbers, or other financial account information, and billing address.

We may collect additional Personal Information to validate your identity, such as your date of birth, place of birth, or taxpayer identification number. We may request documents to verify this information, such as a copy of your government-issued identification or photo, and we may authenticate it against third-party databases or request a credit report.

You may register to join the Predictive Science Platform directly via the Predictive Science Platform or by logging into your account with certain third-party social-networking services (including, but not limited to, LinkedIn) (“SNS”) via our Predictive Science Platform. If you choose to input data via an SNS, we will use the Personal Information you have provided to the SNS (such as your “real” name, email address, gender, and other information you make available via the SNS) to create, modify, or update your account; the information we extract may depend on the privacy settings you have with the SNS. Other than what we may share with the SNS as described below, the Personal Information an SNS has about you is obtained by the SNS independent of our Predictive Science Platform, and Predictive Science is not responsible for its accuracy, legality, or non-infringement. You may link your Predictive Science account to your SNS account, in which case the SNS may share certain information about you with other SNS users, as well as sharing certain information about other SNS users with you. You represent that you are entitled to use your SNS account for the purposes described herein without breach by you of any of the terms and conditions that govern the SNS, and without obligating Predictive Science to pay any fees or making Predictive Science subject to any usage limitations imposed by such SNS. You can disable the link between your Predictive Science account and your SNS account at any time though your SNS settings area such as “Settings” in Predictive Science Platform. Please note that your relationship with any SNS is governed solely by your agreement(s) with such SNS. If your SNS account terminates, then functions enabled through the link between your Predictive Science account and your SNS account will terminate as well.

We also collect other information that you provide in connection with your use of the Predictive Science Platform (e.g., zip code and individual preferences) (“Non-Identifying Information”). We collect additional Non-Identifying Information from Clients in the form of information related to projects posted via the Predictive Science Platform (e.g., budget, location, history of project listings, timing of project performance and feedback/rating information). We also collect additional Non-Identifying Information from Providers in connection with Provider profiles (e.g., information on projects, Services, or Service Contracts previously performed, skills, tests taken, hourly pay rates and feedback/rating information).

We use your Personal Information (in some cases, in conjunction with your Non-Identifying Information) mainly to provide the Predictive Science Platform, complete your transactions, and administer your inquiries.

Certain Non-Identifying Information would be considered a part of your Personal Information if it were combined with other identifiers (for example, combining your zip code with your street address) in a way that enables you to be identified. But the same pieces of information are considered Non-Identifying Information when they are taken alone or combined only with other non-identifying information (for example, your viewing preferences). We may combine your Personal Information with Non-Identifying Information and aggregate it with information collected from other Predictive Science Users to attempt to provide you with a better experience, to improve the quality and value of the Predictive Science Platform, to analyze and understand how our Predictive Science Platform is used, and to generate general industry analysis. We may also use the combined information without aggregating it to serve you specifically, for instance to deliver a product to you according to your preferences or restrictions.

We also use your Personal Information to contact you with Predictive Science emails, newsletters, marketing or promotional materials, and other information that may be of interest to you. If you decide at any time that you no longer wish to receive such communications from us, please follow the unsubscribe instructions provided in any of the communications.

2.2         User Contributions

The Predictive Science Platform contains functionality permitting its Users to make contributions to the Predictive Science Platform. Examples of these contributions include but are not limited to the following (collectively, “User Contributions”):

2.2.1           ProjectRooms

As part of the Predictive Science Platform, we collect information to create ProjectRooms, which help facilitate communication between Clients and Providers in connection with jobs. Such ProjectRooms may include information input by Providers, such as a memo, as well as automatically gathered information, such as Predictive Science credentials, computer identification information, screenshot plus screenshot metadata (which may contain the Provider’s Personal Information), and number of keyboard and mouse events. Predictive Science may use general information from ProjectRooms for statistical analysis, product development, marketing and research. Except as noted above, we do not treat information contained in ProjectRooms as Personal Information, but we may use such information in association with Personal Information, and we may aggregate, analyze and evaluate such information for the same purposes as stated above regarding other Non-Identifying Information. We will share information contained in ProjectRoom only with the Client and with other Providers who share a Client’s ProjectRoom. Providers have the option to review and edit the information included in ProjectRoom before it is locked for billing at the end of the work week.

2.2.2        Project Listings

If you choose to post a project listing via the Predictive Science Platform as a Client, the contents of such project listing will be viewable via the Predictive Science Platform. Project listings include information such as budget, location, history of job listing by the Client, the names of other Providers performing projects for the Client, Client feedback and rating information and timing of project performance. At the time of creating a project listing via the Predictive Science Platform, you may select whether to make projects publicly viewable via the Predictive Science Platform or to edit privacy settings related to the project. If you choose to apply for a project as a Provider via the Predictive Science Platform, we will share with the applicable Client information related to your application, including, but not limited to, the information contained in your Provider profile.

2.2.3           Feedback

We collect feedback from Users about their experience with other Users of the Predictive Science Platform. Please note that any feedback that you provide via the Predictive Science Platform will be publicly viewable via the Predictive Science Platform.

2.2.4           Profiles

Provider Profiles. If you choose to use the Predictive Science Platform as a Provider, you will be able to create a profile, which may be publicly viewable via the Predictive Science Platform. Such profile may include information including, but not limited to, profile picture, a profile video, name, location, information on jobs previously performed via the Predictive Science Platform and outside the Predictive Science Platform, skills, tests taken, hourly pay rates and feedback/rating information. You may edit your Provider profile via your account.

2.2.5           Other User Contributions

You may upload or input other material through the Predictive Science Platform to share or communicate with other Users or recipients. While in certain circumstances you may delete or request removal of information placed by you on the Predictive Science Platform, once the information has been placed on the Predictive Science Platform for any period of time, you understand that other Users or Predictive Science may have saved copies of this material and it may perhaps never be completely removed from the Predictive Science Platform or from the possession of another User.

2.3         Information We Collect Through Automatic Data Collection Technologies

When you visit the Predictive Science Platform, whether as a registered user or a non-registered user just browsing the Predictive Science Platform (a “User”), our servers automatically record information that your browser sends whenever you visit a website (“Log Data”). This Log Data may include information such as your computer’s Internet Protocol (“IP”) address, browser type, browser software version, or the webpage you were visiting before you came to our Site, pages of our the Predictive Science Platform that you visit, the time spent on those pages, information you search for on the Predictive Science Platform, access times and dates, and other statistics. In addition, we may use third party services such as Google Analytics that collect, monitor and analyze this type of information in order to increase the Predictive Science Platform’s functionality and user-friendliness, to better tailor it to our visitors’ needs, and to detect suspicious activity. These third-party service providers have their own privacy policies addressing how they use such information. We do not treat Log Data as Personal Information, but we may use it in association with Personal Information, and we may aggregate, analyze and evaluate such Log Data for the same purposes as stated above regarding other Non-Identifying Information.

2.3.1           Cookies

Like many websites, Predictive Science and our marketing partners, affiliates, analytics, and service providers may use “cookies” to collect information. A cookie is a small data file that we transfer to your computer’s hard disk for record-keeping purposes. We use cookies for two purposes. First, we utilize persistent cookies to save your registration ID and login password for future logins to the Predictive Science Platform and to track your compliance with our policies. Second, we utilize session ID cookies to enable certain features of the Predictive Science Platform, to better understand how you interact with the Predictive Science Platform and to monitor aggregate usage by Predictive Science Users and web traffic routing on the Predictive Science Platform. Unlike persistent cookies, session cookies are deleted from your computer when you log off the Predictive Science Platform and then close your browser. Cookies may also be used in connection with the provision of relevant advertising on the Predictive Science Platform. Advertising-related cookies may be used to optimize advertising delivered to you and may mean that advertising that you may see is based on your behavior on the Predictive Science Platform on based on your behavior on other websites. You can instruct your browser, by changing its options, to stop accepting cookies or to prompt you before accepting a cookie from the websites you visit. If you do not accept cookies, however, you may not be able to use all portions of the Predictive Science Platform or all functionality of it.

2.3.2           Web Beacons

Predictive Science and our marketing partners, affiliates, analytics, and service providers may also employ software technology known as “web beacons” or “tracking tags” to help us keep track of what content on our Service is effective and to serve relevant advertising to you. Web beacons are small graphics with a unique identifier that may be invisible to you, and which are used to track the online activity of Internet users. Web beacons are embedded in the web pages you review or email messages you receive. Web beacons or similar technologies may be used for a number of purposes, including, without limitation, to count visitors to the Predictive Science Platform, to monitor how Users navigate the Predictive Science Platform, to count how many emails that were sent were actually opened, or to count how many particular articles or links were actually viewed.

2.3.3           Other Technologies

In addition to the automatic data collection technologies outlined above, Predictive science may use a variety of other technologies to collect similar information or for security and fraud detection purposes and we may use third parties to perform these services on our behalf.

2.4         How We Respond to Do Not Track Signals

Please note that your browser setting may allow you to automatically transmit a “do not track” signal to websites and online service you visit. Because there is no consensus as to what “do not track” means in this context, Predictive Science does not alter its practices when it receives “do not track” signals from a visitor’s browser.

2.5         Phishing

Identity theft and the practice currently known as “phishing” are of great concern to Predictive Science. Safeguarding information to help protect you from identity theft is a top priority. We do not and will not, at any time, request your credit card information, your account ID, login password, or national identification numbers in a non-secure or unsolicited e-mail or telephone communication. 3    HOW WE USE YOUR INFORMATION


3.1          Transfer of Information

Your information may be transferred to—and maintained on—computers located outside of your state, province, country or other governmental jurisdiction where the privacy laws may not be as protective as those in your jurisdiction. If you are located outside the United States and choose to provide information to us, Predictive Science transfers Personal Information to the United States and processes it there. Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.

3.2         Information about Clients or Providers Shared with Other Clients or Providers

We share information regarding Providers, including information about work history, with Clients and vice versa. Note that if a Provider is suspended from the Predictive Science Platform, we may share that information with Clients for whom that Provider has worked or applied for work. We may also share information with an Agency to whom Providers are associated for a particular work project. If you choose to apply for or request work through the Predictive Science Platform, we will share information relevant to your application or request with the applicable Client or Provider, including, but not limited to, the information contained in your profile.

3.3         Aggregate Information and Non-Identifying Information

We may share aggregated information that does not include Personal Information and we may otherwise disclose Non-Identifying Information and Log Data with third parties for industry analysis, demographic profiling and other purposes. Any aggregated information shared in these contexts will not contain your Personal Information.

3.4         Service Providers

We may employ third-party companies and individuals to facilitate our Predictive Science Platform, to provide the Predictive Science Platform on our behalf, to perform Predictive Science Platform-related services (e.g., without limitation, maintenance services, database management, web analytics, payment processing, fraud detection and improvement of the Predictive Science Platform’s features) or to assist us in analyzing how our Predictive Science Platform and Predictive Science Platform are used. These third parties have access to your Personal Information only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose.

3.5         Compliance with Laws and Law Enforcement

Predictive Science cooperates with government and law enforcement officials and private parties to enforce and comply with the law. We will disclose any information about you to government or law enforcement officials or private parties as we, in our sole discretion, believe necessary or appropriate to respond to claims and legal process (including but not limited to subpoenas), to protect the property and rights of Predictive Science or a third party, to protect the safety of the public or any person, or to prevent or stop activity we may consider to be, or to pose a risk of being, illegal, unethical or legally actionable activity.

3.6         Business Transfers

Predictive Science may sell, transfer or otherwise share some or all of its assets, including your Personal Information, in connection with a merger, acquisition, reorganization or sale of assets or in the event of bankruptcy.

3.7         Accessing, Correcting, and Deleting Your Information

All registered users may access, update, correct, or delete the Personal Information for their registration profile by contacting us at legal@predictivescience.com or by making edits through the Predictive Science Platform on your user account profile page. We may not accommodate a request to change information, if we believe that the change would violate any law or legal requirement or cause the information to be incorrect.

If you completely delete all your Personal Information, then your account may be deactivated. If you would like us to delete your account in our system, please contact us through the Predictive Science Platform. If you delete your User Contributions from the Predictive Science Platform, copies of your User Contributions may remain viewable in cached and archived pages, or might have been coped or stored by other Predictive Science Platform Users. Access and use of information provided on the Predictive Science Platform, including User Contributions, is governed by our Terms of Service.

We will use commercially reasonable efforts to honor your request to change information; however, your Personal Information or User Contributions may remain in our archives. We may retain an archived copy of your records as required by law or for legitimate business purposes. Please bear in mind that neither you nor Predictive Science can delete all copies of information that has been previously shared with others on the Predictive Science Platform.

California Civil Code Section § 1798.83 permits users of the Predictive Science Platform that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. 4    DATA SECURITY


Predictive Science is concerned with safeguarding your information, and we have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure.

The security of your personal information is important to us. When you enter sensitive information (such as credit card number or social security number) on our registration or order forms, we encrypt that information using secure socket layer technology (SSL). In some cases, we also encrypt sensitive information where it is stored on our systems.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Predictive Science Platform, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. We urge you to be careful about giving out information in public areas of the Predictive Science Platform like message boards. The information you share in public areas may be viewed by any user of the Predictive Science Platform.

Unfortunately, the transmission of information via the Internet is not 100% secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to the Predictive Science Platform. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Predictive Science Platform.

We will make any legally required disclosures of any breach of the security, confidentiality, or integrity of your unencrypted electronically stored “personal information” (as defined in applicable state statutes on security breach notification) to you via email or conspicuous posting on this Site in the most expedient time possible and without unreasonable delay, insofar as consistent with (i) the legitimate needs of law enforcement or (ii) any measures necessary to determine the scope of the breach and restore the reasonable integrity of the data system.
